Peru: New law on management of chemical substances (Peru REACH) 

 

Pursuant to Supreme Decree No. 005-2026-MINAM, the Ministry of the Environment of Peru approved the Decree No. 1570 approving the Law on the Comprehensive Management of Chemical Substances, which is similar to EU REACH.

The regulation establishes obligations for public entities and users throughout the entire life cycle of chemical substances, incorporating measures for prevention, monitoring, and enforcement. 

The provisions contained in this Regulation are mandatory for all natural or legal persons, whether public or private, within the national territory, who participate in the integrated management of chemical substances or who are users thereof.  

It covers topics such as: 

  • Hazard classification 
  • Chemical labeling 
  • Safety Data Sheets (SDS) 

It further creates a national registry of chemical substances: 

The National Registry of Chemical Substances (RENASQ) is a declarative registry that aims to integrate and systematize national information on hazardous substances and relevant hazardous substances contained in mixtures manufactured and imported into the country, with a risk management approach, as well as information on their manufacturers and importers, to support decision-making by the competent authorities. 

Moreover, it defines the duties of manufacturers and importers of chemical substances: 

a) Identify and classify the hazards of chemical substancesin accordance withthe provisions of Articles 5 and 6 of these Regulations. 

b) Label chemical substances considering the provisions of Articles 5 and 7 of these Regulations.

c) Prepare and provide SDSsin accordance withthe provisions of Articles 5 and 8 of these Regulations. d) Notify the hazard classification, labeling, and SDS prior to the marketing of chemical substances, in accordance with the provisions of Articles 10 and 11 of these Regulations. 

e) Update and communicate the updated information on the hazard classification,labeling, and SDS of chemical substances when the conditionsset forth in section 13.1 of Article 13 of these Regulations are met, within the established timeframe. 

f) Physically and/or digitally safeguard the information that supports the hazard classification assigned to the chemical substances they manage for a period of no less than ten (10) years for manufacturers and/or importers. This information must besubmittedto the inspector and/or the administrative inspection authority, in accordance with the provisions of section 6.4 of Article 6 of these Regulations and other applicable regulations. g) Submit the revised and updated Safety Data Sheets (SDS) for the chemical substances to the competent authority within the timeframe established in section 8.7 of Article 8 of these Regulations. 

h) Report information to RENASQ on chemical substances classified as hazardous,in accordance withthe provisions of Article 22 of these Regulations, within the timeframe established in Article 21 of these Regulations. 

i) Provide the confidential information requested by MINAM within the framework of an Environmental Emergency Declaration, within thetimeframesestablished in Article 48 of these Regulations. 

j) Submit the Environmental Risk Assessments (ERSQ) or corresponding informationin accordance withthe provisions of Articles 28, 30, and 31 of these Regulations. 

The regulation will enter into force within six months.
