EU: New regulation for detergents and surfactants

 

The European Union has adopted Regulation (EU) 2026/405 on detergents and surfactants, marking a major overhaul of existing rules. Published on March 2, 2026, the regulation replaces the long-standing framework established by Regulation (EC) 648/2004 and represents the most substantial update to EU detergent legislation in over 20 years.

Key requirements

The new regulation broadens and modernizes the regulatory framework with several notable changes:

  • Expanded scope: Now covers detergents with microbial components (such as probiotic cleaners), as well as refill systems, online sales, and digital tools.
  • Stricter biodegradability standards: Products must meet tougher criteria for ultimate aerobic biodegradation.
  • Extended testing obligations:
  • Films and polymers must comply starting March 23, 2032.
  • Organic substances present at ≥10% by weight must comply from March 23, 2034.
  • Updated labeling rules:
  • Inclusion of a Unique Formula Identifier (UFI).
  • Physical labels must provide essential safety information, usage guidance, hazard details, allergen and preservative disclosures, dosage instructions, and all required CLP/biocide elements.
  • Optional digital labels (e.g., QR codes) may include full formulation details.
  • Digital labeling framework: The European Commission will define acceptable IT systems and access methods by October 1, 2028.
  • Fragrance allergen disclosure: Harmonized with cosmetics legislation.
  • Non-animal testing: Mandatory use of validated alternatives for compliance.
  • Digital Product Passport (DPP): Introduced to store key product data linked to a unique EU registry identifier; authorized representatives are required where relevant.
  • Conformity assessment: New procedures set out in Annex IV.
  • Market surveillance: Strengthened and aligned with EU-wide enforcement rules.

Who it affects

The regulation applies to all economic operators placing detergents and surfactants on the EU market, including manufacturers, importers, distributors, and online sellers.

Timeline and transition

  • Entry into force: March 22, 2026
  • Full application: September 23, 2029 (replacing Regulation (EC) 648/2004)
  • Later deadlines for biodegradability testing:
  • Films and polymers: March 23, 2032
  • Organic substances ≥10%: March 23, 2034

Transitional provisions

  • Products compliant with the previous regulation and already on the market before September 22, 2029, can continue to be sold without time limit.
  • Products placed on the market between September 22, 2029, and September 23, 2030, may remain available until September 23, 2030.

Overall, Regulation (EU) 2026/405 introduces stricter environmental standards, enhanced transparency through digital tools, and updated compliance mechanisms for the detergent sector.
