South Korea: Changes to Korean REACH

 

South Korea has published Draft partial amendment of the Enforcement Rule of the Act on Registration and Evaluation of Chemical Substances, which changes the Korea REACH legislation.

The amendment is contained in the public Notice of the Ministry of Environment No. 2024-455

The following changes are being made through the amendment:

  1. When some part of registration dossier is waived and is not submitted pursuant to paragraph 1 of Article 14 of the Act on Registration and Evaluation of Chemical Substances (hereinafter referred to as “the Act”) and Article 13 of the Enforcement Decree of the Act (hereinafter referred to as “the Enforcement Decree”), the potential registrant may not submit the entire or some of evidence data. (Please refer to Article 5(1)5, and subparagraph 1, 2 and 3 of Article 5(1)5 of the Enforcement Rule.)
  2. The Enforcement Rule, as a subordinate law, is amended as follows, corresponding to the amended Enforcement Decree in which states chemical substances manufactured by recycling wastes according to Article 2(1) of the Wastes Control Act are exempted from notification or registration pursuant to Article 11 of the Act:

– Stating application cycle for confirmation of exemption from registration, etc. of chemical substances that are manufactured by recycling wastes (Please refer to Article 7(4) and Article 7(4)2 of the Enforcement Rule.); and

– Specifying how to prepare the data that are required for confirmation of exemption from registration, etc. of chemical substances manufactured by recycling wastes. (Please refer to subparagraph 7 of paragraph 2 of Attachment 5 of the Enforcement Rule.)

3. More information will be provided to those apply for registration of chemical substances when the government informs whether their applications are accepted or not, in accordance with Article 16(2) of the Act and Article 20 of the Enforcement Rule. (Please refer to Form No. 13 of the Attachment of the Enforcement Rule).

The Proposed date of adoption is 10 October 2024.
