Vietnam: Two new important product laws

 

Vietnam has published two new big regulations regarding quality of products, their technical standards, product labelling, sales, consumer protection, etc.

The regulations are:

• Draft Decree detailing a number of articles and measures for implementing the Law on Standards and Technical Regulations
• Draft Decree detailing the implementation of a number of articles of the Law on Quality of Products and Goods and the Law Amending and Supplementing a number of articles of the Law on Quality of Products and Goods, and on goods labelling

The first draft decree specifies a number of provisions and implementation measures for the Law on Standards and Technical Regulations 2006 and the Law on Amendments and Supplements to Certain Articles of the Law on Standards and Technical Regulations 2025 (hereinafter collectively referred to as the Law on Standards and Technical Regulations). It covers the formulation and promulgation of standards; the development and issuance of technical regulations; activities related to standards, technical regulations, and conformity assessment; as well as the responsibilities of agencies, organizations, and individuals involved in these areas.

This decree also elaborates on specific articles and implementation measures under the Law on Standards and Technical Regulations and the Law on Investment, particularly with respect to business conditions in the field of conformity assessment services.

The draft applies to Vietnamese organizations and individuals, foreign organizations and individuals, and overseas Vietnamese engaged in activities related to standards, technical regulations, and conformity assessment.

The second draft decree provides detailed provisions for the implementation of certain articles of the Law on Product and Goods Quality and the Law Amending and Supplementing Certain Articles of the Law on Product and Goods Quality. It focuses on state management of product and goods quality, the responsibilities of competent authorities in this regard, the development of national quality infrastructure, the application of technology in quality management and product traceability, the labeling of goods (both physical and electronic), and the National Quality Awards.

This decree applies to organizations and individuals engaged in the production and trading of products and goods, as well as to those involved in quality-related activities such as numbering, barcoding, labeling (including electronic labels), digital product passports, product and goods traceability, conformity assessment, and participation in the National Quality Awards in Viet Nam.The relevant regulations which are affected by the two new regulations are:

– Law on Standards and Technical Regulations 2006;

– Law on Amendments and Supplements to a Number of Articles of the Law on Standards and Technical Regulations 2025;

– Law on Product and Goods Quality 2007;

– Law Amending and Supplementing a Number of Articles of the Law on Quality of Products and Goods 2025;

– Law on Investment 2020

– Law on Government Organization dated February 18, 2025, and Law on Organization of Local Administration dated February 19, 2025;

– Law on Organization of Local Administration dated February 19, 2025, and Law Amending and Supplementing a Number of Articles of the Law on Organization of Local Administration dated June 16, 2025;

– Law on Standards and Technical Regulations dated June 29, 2006; and Law Amending and Supplementing a Number of Articles of the Law on Standards and Technical Regulations dated June 14, 2025;

– Law on Quality of Products and Goods dated November 21, 2007; and Law Amending and Supplementing a Number of Articles of the Law on Quality of Products and Goods dated June 18, 2025;

– Commercial Law dated June 14, 2005;

– Law on Protection of Consumers’ Rights dated June 20, 2023.
