USA: CPSC Electronic Filing of Certificate of Compliance Required Beginning July 8, 2026

 

Effective July 8, 2026, the U.S. Consumer Product Safety Commission (CPSC) will require electronic filing of Certificate of Compliance (CoC) data for regulated consumer products imported into the United States. 

Since 2008, importers have been required to maintain a Certificate of Compliance for covered products and provide it to the CPSC or U.S. Customs and Border Protection (CBP) upon request. The new requirement does not change which products are subject to CPSC regulations. Instead, it changes how the required certificate information is submitted. Beginning July 8, 2026, CoC data must be transmitted electronically as part of the customs entry filing. 

Approximately 600 Harmonized Tariff Schedule (HTS) numbers will be flagged for potential electronic filing. However, this list is not exhaustive, and products subject to CPSC requirements may fall outside those HTS classifications. 

Examples of products commonly subject to CPSC regulations include, but are not limited to: 

• ATVs 

• Durable infant and toddler products (such as strollers, cribs, and safety gates) 

• Children’s furniture, backpacks, and school supplies 

• Caschi da bicicletta 

• Bicycles and other electric-powered cycles 

• Certain apparel 

• Fireworks 

• Children’s jewelry 

• Lighters 

• Liquid nicotine products 

• Mattresses 

• Pacifiers and rattles 

• Rugs 

• Giocattoli 

Electronic Filing Requirements 

 

Importers must provide all required Certificate of Compliance data to their customs broker so the CPSC Participating Government Agency (PGA) message set can be submitted through the Automated Commercial Environment (ACE) with the customs entry. 

Importers may choose one of two filing methods: 

1. Full PGA Message Set – Submit all seven required Certificate of Compliance data elements for each regulated product in every shipment. 

1. CPSC Product Registry – Upload certificate information to the CPSC Product Registry and submit a shortened PGA reference message with each entry. 

Required Certificate Data 

The electronic filing must include the following seven data elements: 

1. Product identification (SKU, GTIN, part number, or other unique product identifier) 

1. Each applicable CPSC regulation or safety rule to which the finished product is certified 

1. Date the finished product was manufactured 

1. Name and address of the manufacturing, production, or assembly location 

1. Date the finished product was most recently tested for compliance 

1. Name, address, and contact information of the testing laboratory or entity that performed the testing 

1. Contact information for the importer or other party maintaining the test reports and compliance records 

No Value-Based Exemptions 

 

Electronic filing is required regardless of shipment value, entry type, or product value. There are no low-value, de minimis, or direct-to-consumer exemptions for products subject to CPSC certification requirements. 

Importer Responsibilities 

 

Although the method of submission is changing, the underlying CPSC entry requirements remain the same. Rather than providing a paper Certificate of Compliance upon request, importers must now submit the required certificate information electronically with the customs entry. 

IL Importer of Record (IOR) remains ultimately responsible for ensuring compliance with all CPSC Certificate of Compliance requirements, including the accuracy and timely electronic submission of the required data. 

While manufacturers, suppliers, exporters, and testing laboratories typically generate the certification and testing information, regulatory responsibility rests with the IOR at the time of import.

Importers should begin preparing now by: 

1. Identifying all products subject to CPSC standards that require a Certificate of Compliance. 

1. Confirming that all seven required data elements are available and accurate. 

1. Determining whether to file using the full PGA message set or the CPSC Product Registry. 

1. Coordinating with manufacturers, suppliers, testing laboratories, customs brokers, and other supply chain partners to ensure readiness before the July 8, 2026 implementation date.
