Turkey: Draft framework regulation on ecodesign requirements for sustainable products

 

Turkey has published a Draft framework regulation on ecodesign requirements for sustainable products. The purpose of this Regulation is to establish a framework to enhance the sustainability of products by improving their environmental performance and reducing their overall carbon and environmental footprint across their entire life cycle. It aims to ensure the free movement of products on the market, define the ecodesign requirements applicable to products placed on the market or put into service, introduce a digital product passport, and prevent the destruction of unsold consumer products.

This Regulation has been adopted pursuant to Article 4 of the Law on Product Safety and Technical Regulations No. 7223, dated 5 March 2020.

It has been prepared in alignment with European Union legislation, taking into consideration Regulation (EU) 2024/1781 of the European Parliament and of the Council of 13 June 2024, which establishes a framework for ecodesign requirements for sustainable products.

It applies to all physical products, including components and intermediate products, that are placed on the market or put into service, apart from:

  • Food as defined in paragraph 24 of the first clause of Article 3 of the Veterinary Services, Plant Health, Food and Feed Law, numbered 5996 and dated 11/6/2010.
  • Feed as defined in paragraph 79 of the first clause of Article 3 of the Veterinary Services, Plant Health, Food and Feed Law, numbered 5996 and dated 11/6/2010.
  • Medicinal products for human use as defined in subparagraph (b) of the first clause of Article 4 of the Regulation on the Licensing of Medicinal Products for Human Use, published in the Official Gazette numbered 31686 and dated 11/12/2021.
  • Veterinary medicinal products as defined in subparagraph (kk) of the first clause of Article 4 of the Regulation on Veterinary Medicinal Products, published in the Official Gazette numbered 28152 and dated 24/12/2011.
  • Live plants, animals, and microorganisms.
  • Products of human origin.
  • Plant and animal products directly related to their future reproduction.
  • Vehicles as defined in the second clause of Article 1 of the Regulation on Type-Approval and Market Surveillance of Agricultural and Forestry Vehicles (EU/167/2013), published in the Official Gazette numbered 29088 and dated 14/08/2014; the third clause of Article 1 of the Regulation on Type-Approval and Market Surveillance of Two- or Three-Wheel Vehicles and Quadricycles (EU/168/2013), published in the Official Gazette numbered 29453 and dated 22/08/2015; and the fourth clause of Article 1 of the Regulation on the Type-Approval and Market Surveillance of Motor Vehicles and Trailers, and Systems, Components and Separate Technical Units Intended Therefor (EU/2018/858), published in the Official Gazette numbered 31104 and dated 19/04/2020.

In accordance with the regulation:

Products may be placed on the market or put into service only if they comply with the ecodesign requirements set out in the implementing communiqués issued by the competent authority pursuant to Article 6 of this Regulation, in alignment with the ecodesign requirements legislation adopted by the Commission.

The competent authority shall not prohibit, restrict, or otherwise hinder the placing on the market or putting into service of products that comply with the performance requirements laid down in the communiqués adopted under Article 6 of this Regulation, on the grounds of non-compliance with national performance requirements relating to the product parameters listed in Annex I (“Product Parameters”) of this Regulation, where such parameters are already covered by the performance requirements contained in those communiqués.
