Mongolia: Updates to the Law on “Standardization, technical regulation and accreditation of conformity assessment”

 

Mongolia has published a draft law on “‘Standardization, technical regulation and accreditation of conformity assessment” to establish legal framework for standardization, technical regulation and accreditation of conformity assessment, to ensure quality and safety of products, productions and services.

In accordance with the draft:

Purpose and scope of conformity assessment are:

13.1 .  Products are subject to conformity assessment in order to ensure product safety, increase competitiveness, and protect consumer rights and interests.

13.2 .  Products that may cause harm to human or animal health, the environment, or public interest shall be subject to conformity assessment.

13.3 .  The list of products subject to mandatory conformity assessment shall be approved by the Government based on the proposal of the Central Organization for Standardization and Conformity Assessment.

13.4 .  Products other than those subject to mandatory management system and conformity assessment may be subject to conformity assessment at the request of the manufacturer, supplier or user.

A guarantee of conformity is needed for products:

14.1 .  The guarantee of conformity shall take the form of a certificate of conformity and a supplier’s declaration.

14.2 .  The Central Organization for Standardization and Conformity Assessment shall recognize conformity marks and certificates agreed upon by Mongolia through agreements and treaties with international, regional organizations, and trade partner countries.

14.3 .  The Certificate of Conformity is valid in Mongolia and in countries agreed upon by Mongolia through agreements and treaties concluded with international and regional organizations and trade partner countries.

14.4 .  The requirements for supplier declarations shall be established by standards.

14.5 .  The supplier’s declaration shall be registered with the central body for standardization and conformity assessment.

14.6 .  The standardization and conformity assessment body shall issue a certificate of conformity for exported products.

14.7 .  Conformity and safety marks and the requirements for them shall be established by standards.

14.8 .  The conformity mark shall be issued by an accredited certification body, and the safety mark shall be issued by the Central Organization for Standardization and Conformity Assessment.
