Spain: New decree for construction products
Span has published a new draft of a decree for construction products.
It is called Real Decreto por el que se establecen disposiciones relativas a los productos de construcción.
This draft royal decree develops aspects of Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024, laying down harmonised rules for the placing of construction products on the market and repealing Regulation (EU) No 305/2011, such as the treatment of construction products in building codes and the sanctions regime. In addition, this royal decree also aims to update national legislation for certain products to which European legislation does not apply.
On the one hand, the draft royal decree addresses the implementation in Spain of certain aspects of Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024, laying down harmonised rules for the placing of construction products on the market and repealing Regulation (EU) No 305/2011. On the other hand, the draft royal decree establishes requirements for some products not subject to European regulations.
The rationale for the draft decree is that certain aspects of Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024 must be developed at the national level, such as the sanctions regime. At the same time, there are some products related to the construction sector that are not subject to this European regulation, and for these, in the absence of European regulations, national requirements must be established to ensure the safety of construction projects where these products are used.
The proposed date for adoption and entry into force is the end of 2026 or beginning of 2027.
