Do all products bearing the CE mark undergo testing and approval by European authorities?

No, that’s not the case. The responsibility for assessing the conformity of products with legislative requirements lies with the manufacturer. The manufacturer is tasked with affixing the CE marking and preparing the EU Declaration of Conformity. Generally, only products deemed to pose a significant risk to public safety, such as pressure vessels, lifts, and specific machine tools, necessitate a conformity assessment conducted by a third party, namely a notified body.

Are EN testing standards obligatory?

The Community Directives aim to remove obstacles hindering the unrestricted movement of products. Consequently, each directive furnishes qualitative guidelines to safeguard the health and safety of users, goods, and the environment, with assessments conducted through standards.

While compliance with the relevant directive/s is mandatory, adherence to standards is voluntary. To ensure compliance with the essential requirements outlined by the directives, the use of Harmonised Standards (technical specifications created by CEN, CENELEC, or ETSI, published in the OJEU, and adopted as a National Regulation by at least one Member State) is recommended, as it implies conformity with these essential requirements.

Manufacturers have the freedom to employ alternative methods to meet the essential requirements but must guarantee a minimum level of safety equivalent to that established by the harmonised standards. Failure to use these standards, depending on the directive, may necessitate an Examination Type conducted by a Notified Body.

What is the process for obtaining CE certification for my product if my company is located outside the EU?

The procedure for applying the CE mark remains consistent regardless of whether your company is situated within the EU or not:
