Thailand: Regulatory update on product labelling 

 

Thailand has published a new regulation on general product labelling. It is called: Draft Notification of the Committee on Labels Re: Prescribing Categories of Goods as Label-Controlled Goods. 

This draft notification repeals the existing notifications prescribing categories of label-controlled goods and prescribes revised categories of goods as label-controlled goods under the Consumer Protection Act B.E. 2522 (1979).  

The prescribed goods fall within the following categories:  

• household goods;  

• personal use products;  

• paper, paper products and stationery;  

• electrical appliances and equipment;  

• motor vehicle equipment;  

• agricultural goods;  

• construction materials;  

• and other goods.  

From the category of household goods, the following products are affected: 

1. Mirrors.
2. Toilet paper, facial tissues, and multipurpose toilet paper, excluding multipurpose toilet papercontainingcleaning or disinfecting agents used on floors, walls, sanitary ware, and other materials used in households or public health settings.  
3. Water bottles, kettles, drinking glasses, plates, bowls, cups, trays, spoons, forks, and chopsticks, excluding food-contact plastic containers and microwave-safe plastic food containers subject to ministerial regulations or royal decrees issued under the Industrial Product Standards Act (mandatory standards).
4. Basins, water bowls, baskets, and water buckets, excluding plastic products subject to labeling regulations under the Consumer Protection Act.
5. Chairs, cabinets, tables, and beds, excluding chairs, cabinets, tables, and beds made from plastic products subject to labeling regulations under the Consumer Protection Act. And hospital beds;
6. Lamps, flashlights;
7. Gas stoves, exhaust fans, charcoal stoves, grills, spare parts, accessories, gas stove ignition devices, excluding matches, gas lighters, electric grills or barbecues that are subject to ministerial regulations or royal decrees issued under the authority of the Industrial Product Standards Act (mandatory standards);
8. Dustpans, floor brushes, brooms, mops;
9. Blankets, mosquito nets, mats, pillows, pillowcases, bed sheets;
10. Fabric softener, excluding fabric softener used for disinfection in households or public health;
11. Deodorizing or antiperspirant products that do notcome into contact withthe human body;  
12. Towels, cleaning cloths, excluding cleaning clothscontainingcleaning or disinfecting agents used on floors, walls, sanitary ware, and other materials.  
13. Curtains, blinds, and accessories used in households or public health.
14. Clothes hangers, ready-made clothes racks, and other equipment used for drying clothes.
15. Seat cushions.

From the category of motor vehicle equipment, the following products are affected: battery, window tint film, car spray paint. 

In accordance with the regulation, labels of goods subject to label control under Section 2 shall comply with Sections 1, 2, 3, and 3 bis (1) and (2) of the Announcement of the Labeling Committee on the Characteristics of Labels of Goods Subject to Label Control B.E. 2541 (1998) and its amendments. 

The revision aims to improve consistency with sector-specific legislation governing certain goods, ensure that consumers receive accurate and sufficient information on the essential characteristics of goods through labelling, and avoid imposing unnecessary regulatory burdens on business operators. 

The two repealed regulations are: 

• Notification of the Committee on Labels Re: Prescribing Categories of Goods as Label-Controlled Goods, B.E. 2565 (2022) (Repealed) 

• Notification of the Committee on Labels Re: Prescribing Categories of Goods as Label-Controlled Goods (No. 2), B.E. 2566 (2023) (Repealed)
