EU: Amendments to the regulation on export and import of hazardous chemicals
The EU Commission has announced a new draft law to update the regulation on export and import of hazardous chemicals.
The initiative aims to add new hazardous chemicals to Regulation (EU) No 649/2012 on the export and import of hazardous chemicals implementing the Rotterdam and Stockholm Conventions.
The Regulation ensures that unwanted imports are prevented and information on hazards, risks and safe handling is exchanged when these chemicals are exported. After the listing, a specific condition for export will apply (export notification and/or explicit consent request), while the export of those substances listed in the Stockholm Convention will be banned.
Context:
The delegated act updates the lists of chemicals in Annexes I and V to Regulation (EU) No 649/2012 to reflect developments in EU legislation and under the Rotterdam Convention. In accordance with Article 23(1) of Regulation (EU) No 649/2012 on the export and import of hazardous chemicals, the Commission is required to review these lists at least annually, taking into account relevant regulatory developments at both EU and international level.
The amendments incorporate a number of final regulatory actions adopted under Regulation (EC) No 1107/2009 on the placing of plant protection products on the market that are not yet reflected in Annex I. They also consider legal developments under Regulation (EU) No 528/2012 on biocidal products and Regulation (EC) No 1907/2006 (REACH) concerning the registration, evaluation, authorisation and restriction of chemicals.
