Thailand: Updates to the Hazardous Substances Act, B.E. 2535 (1992)
Thailand has published a draft regulation updating the Hazardous Substances Act, B.E. 2535 (1992).
It is called Draft Notification of the Ministry of Public Health regarding the Import Exemption from Compliance with the Hazardous Substances Act, B.E. 2535 (1992), of Hazardous Substances under the Responsibility of the Food and Drug Administration, B.E.
It introduces some import exemptions for hazardous substances. It revises the criteria, conditions, and required documentation for exemption from compliance with the Hazardous Substances Act, B.E. 2535 (1992), to import hazardous substances for the following purposes:
– a hazardous substance imported for personal use;
– a hazardous substance imported for occasional purposes;
– a hazardous substance imported for exhibitions;
– a hazardous substance imported for the use of, or transfer to, an agency that shall comply with the international standards for the utilization of such hazardous substance;
– a hazardous substance imported to be transferred to a Ministry, sub-Ministry, Department, local administrative office, state enterprise, state agency, Red Cross, International Red Cross, or an international agency under the law on the protection of the operation of the United Nations and specialized agencies in Thailand.
Moreover, it prescribes the criteria, conditions, and required documentation for exemption from compliance with the Hazardous Substances Act, B.E. 2535 (1992), regarding the importation of hazardous substances for the new purpose: the production of foreign films or commercials in Thailand.
The importation of hazardous substances under the above terms shall not be for sale and must be approved by the FDA in accordance with the criteria and conditions annexed to this draft notification.
The submission of required import documentation shall be primarily made through the designated electronic network of the FDA. In the event that such submission cannot be completed via the FDA’s network, the documentation shall be submitted at the Food and Drug Checkpoint where the importation takes place.
The draft act also repeals two existing laws:
– Notification of the Ministry of Public Health regarding the Import Exemption from Compliance with the Hazardous Substances Act, B.E. 2535 (1992), relating to Notification, Application for Licensing and Application for Registration of Hazardous Substances under the Responsibility of the Food and Drug Administration, B.E. 2548 (2005);
– Notification of the Ministry of Public Health regarding the Import Exemption from Compliance with the Hazardous Substances Act, B.E. 2535 (1992), relating to Notification, Application for Licensing and Application for Registration of Hazardous Substances under the Responsibility of the Food and Drug Administration (No. 2), B.E. 2568 (2025).
