Turkey: The new EU Machinery Regulation in Turkey

The Turkish Ministry of Industry and Technology has recently published a draft of the Machinery Safety Regulation (2023/1230/EU), much harmonized with the recent EU Machinery Regulation.

Machinery and related products must comply with essential health and safety requirements when they are introduced to the market or put into service, while also ensuring their free movement within the Türkiye-EU customs union. The Regulation promotes harmonization by integrating mandatory health and safety requirements with voluntary harmonized standards for machinery and related products. It applies to products being placed on the market for the first time, or when existing machinery undergoes modifications substantial enough to be considered new machinery.

The Regulation aims to establish health and safety requirements for the design and construction of machinery, related products, and partly completed machinery. This ensures their availability on the market or in service while maintaining a high level of protection for the health and safety of individuals, particularly consumers and professional users. Additionally, it seeks to protect domestic animals, property, and, where applicable, the environment, while also setting rules for the free movement of products within the scope of the Regulation.

The Regulation applies to machinery and the following related products;

a) interchangeable equipment;

b) safety components;

c) lifting accessories;

ç) chains, ropes and webbing;

d) removable mechanical transmission devices.

(2) This Regulation also applies to partly completed machinery.
