China: New measures for the importation of cosmetics.
China has published Measures of the Customs of the People’s Republic of China for the Administration of Inspection and Supervision of Import and Export Cosmetics.
In accordance with its article 4 [Main responsibility for quality and safety of producers and operators] Import and export cosmetics manufacturers and operators are responsible for the quality and safety of the imported and exported cosmetics they produce and operate.
The regulation further says, with regard to the Import of Cosmetics Article 8 [Applicable Standards]: Customs shall inspect imported cosmetics in accordance with the mandatory requirements of national technical specifications. If our country has not formulated mandatory requirements for national technical specifications, inspections may be carried out with reference to relevant foreign standards designated by the General Administration of Customs.
Article 9 [Inspection Location] Imported cosmetics shall be inspected by the customs office of the destination declared by the consignee. The General Administration of Customs may designate other locations for inspection based on the needs of facilitating trade and import inspection work.
Article 10 [Consignee Review] The consignee of imported cosmetics shall review the cosmetics to be imported in accordance with the provisions of paragraph 2 of Article 45 of the “Cosmetics Supervision and Administration Regulations”.
Article 11 [Import and Sales Records] The consignee of imported cosmetics shall establish cosmetics import and sales records, keep relevant vouchers, and be responsible for the authenticity and completeness of the recorded information to ensure traceability.
Moreover, in accordance with Article 15 [Labeling Requirements] Labeling of imported cosmetics finished products shall comply with the mandatory requirements of laws, administrative regulations and national technical specifications.
