Denmark: New decree for the extended producer responsibility for single-use plastics
Denmark has published a new Decree on extended producer responsibility for certain disposable plastic products.
The draft contains provisions on an obligation for producers who market certain disposable plastic products to have themselves or their representative registered in a producer register, cf. §§ 3-9 of the draft.
It contains provisions on an obligation for the manufacturer to report information on the marketed quantity and category of single-use plastic products to the organization responsible for the producer register (Danish Producer Responsibility), cf. § 10 of the draft, and an obligation to pay a fee for registration, cf. § 12 of the draft.
The draft also contains provisions on an obligation for the producer to pay a fee per product category for the Environmental Protection Agency for the municipal and state clean-up and collection of waste from single-use plastic products, cf. section 13 of the draft.
In addition, the draft contains provisions on producers’ self-control, collective arrangements, the administrative cooperation of the Environmental Protection Agency and Danish Producer Responsibility and the storage of documents, and provisions on supervision, complaints and penalties.
The purpose of the draft is to introduce extended producer responsibility for certain single-use plastic products marketed in Denmark. The draft has been prepared in accordance with Article 8 of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on reducing the environmental impact of certain plastic products.
