Great Britain: Updates about the UKCA and the CE marking
Great Britain has published the Product Safety and Metrology etc. (Amendment) Regulations 2024.
Several months ago, the United Kingdom has announced its intention to provide businesses with the flexibility to continue to place goods that meet current EU requirements, including the CE marking, on the market in Great Britain. This will apply to most manufactured products and this approach will cover 21 product regulations. These regulations cover a range of manufactured products including mobile phones, lifts, industrial machinery, toys and household appliances. The list of the regulations is available HERE.
The United Kingdom is set to implement a ‘Fast-Track UKCA’ measure, enabling manufacturers to utilize the UKCA marking for compliance demonstration in Great Britain. This can be done with respect to either UKCA or EU product requirements, where acknowledged. In cases involving multiple regulations, a combination of UKCA and CE conformity assessment procedures is permissible.
Regarding the regulation of hazardous substances (RoHS) in electrical equipment, we are adopting a two-pronged approach. If products adhere to the maximum concentration values outlined in Annex II of the EU RoHS Directive (2011/65/EU), the current EU regulations and CE marking will be upheld. In instances where a product relies on an exemption, recognition of current EU regulations and CE marking will continue, provided there is a corresponding exemption in the GB RoHS regulations.
It is important to note that this legislation pertains to Great Britain (comprising England, Scotland, and Wales) and does not extend to Northern Ireland.
