Philippines: New toys regulation in Philippines
Philippines has launched a public consultation regarding a new toys regulation.
The name of the new regulation is Rules and Regulations Governing the Issuance of Authorizations for Toys and Childcare Articles.
It aims to:
- Update and align TCCA (toys and child care articles) regulations with appropriate laws, locally-established standards, and internationally-accepted standards;
- Institutionalize the Product Notification procedure for toys and childcare articles;
- Rationalize the issuance of Certificates of Exemption for exempted toys, games, and childcare articles; and,
- Provide the roles and responsibilities of marketing authorization holders in ensuring the safety, efficacy, and quality of toys and childcare articles throughout the product life cycle.
The regulation updates existing regulations for toys and childcare articles on licensing, notification, and labelling requirements under DOH AO No. 2009-005, FDA Circular 2015-002, and Republic Act No. 10620.
It affects all establishments engaged in the manufacture, packing, repacking, importation, exportation, sale, offer for sale, distribution, transfer, use, testing, promotion, advertising, and sponsorship of toys and articles intended for use by 16 children less than fourteen (14) years of age.
When in force, the regulation will simplify and harmonize the Philippine conformity system for toys.
The public consultation is open till 14 January 2024.
