Taiwan: Amendments to toy legislation

 

Taiwan has notified that the final text of text of “Amendments to the Legal Inspection Requirements of Toys” (which was announced in May 2023) has been published (with minor changes) along with relevant dates of its implementation.

With a view to ensuring the safety of consumers, the Bureau of Standards, Metrology and Inspection (BSMI), the body in charge of product compliance in Taiwan, is has proposed to adopt the updated version of CNS and ISO 8124-1:2022 (Flying toys’ section) as inspection standards. The conformity assessment procedures remains the same, i.e. Monitoring Inspection (MI), Registration of Product Certification (RPC) or Declaration of Conformity (DOC).

Moreover, the BSMI has proposed to remove 2 categories of toys (Stuffed toys and Blocks) from the list of products subject to Monitoring Inspection (MI) or Registration of Product Certification (RPC). These products are assessed to be of low risk and shall be subject to the conformity assessment procedure of Declaration of Conformity (DOC), which requires tests to be performed at designated testing laboratories and a declaration of conformity be issued for declaring that the products comply with relevant inspection standards.

The date of entry into force of the amendments is 1 March 2024.
