France: Decree relating to the minimum proportion of reused packaging to be marketed annually
France has recently published the Décret relatif à la proportion minimale d’emballages réemployés à mettre sur le marché annuellement which defines the minimum proportion of reused packaging to be marketed annually.
The decree defines, for the years 2023 to 2027, the minimum proportion of reused packaging to be placed on the market annually in France in order to achieve the reuse objectives set by article L. 541- 1 of the Environment Code, i.e.:
- 5% in 2023;
- 6% in 2024;
- 7% in 2025;
- 8% in 2026;
- 10% in 2027
The Decree affects: packaging manufacturers, producers, importers, distributors or other marketers of products using packaging, eco-organizations referred to in Article L. 541-10, organizations dealing with reuse activities.
Affected companies are allowed to come together within a collective structure or to rely on their eco-organization to fulfill their reused packaging obligation.
The possibility for producers to rely on the eco-organization with which they are already a member for their extended responsibility obligation (EPR) by paying them an eco-contribution will greatly facilitate the implementation of this new obligation.
In return, the decree specifies that the eco-organizations approved for packaging are responsible for developing the reuse of packaging on behalf of producers.
This decree comes into force on January 1, 2023.
